1. DEFINITIONS<\/h3>\n

To allow for a complete understanding and acceptance of these terms, the following terms, in singular and plural, shall have the meanings indicated below:

\n\u201cSite\u201d: the website https:\/\/infuga.net\/.
\n\u201cCustomer\u201d: means a user who books and\/or makes a purchase on the Website.
\n\u201cService\u201d or \u201cEscape Room\u201d or \u201cGame\u201d: refers to the Escape Room game experience offered on the Website.
\n\u201cConditions\u201d: this distance online purchase contract for the Service concluded between the Company and the Customer.
\n\u201cOnline Payment\u201d: refers to paying for the Service directly via the Website.
\n\u201cPayment at the Venue\u201d: refers to payment for the Service purchased through the Website at the venue where the gaming experience will take place.<\/p>\n

2. SCOPE OF THE CONDITIONS<\/b><\/p>\n

By purchasing the Service via the Website, the Customer accepts the Conditions.
\nThe Customer is required to examine and approve the Terms and Conditions by selecting the appropriate box.
\nThe Customer declares to be aware that the Terms and Conditions constitute a legally binding agreement with the Seller for the provision of the Service.
\nThe Conditions may be amended at any time.
\nAny modifications and\/or new conditions will be effective from the moment of their publication on the Site.
\nCustomers are therefore invited, upon accessing the Site and before making any purchase, to consult the most up-to-date version of the Terms and Conditions.

3. GAME BOOKING<\/b><\/p>\n

To book the Escape Room, the Customer must complete the appropriate booking form on the Website, entering their personal details and all required information, including the choice between Online Payment and Payment on Site.
\nThe Company will then send the Customer an SMS message and an email confirming the booking, which will include some important rules to share with the group participating in the Game.
\nThis message also contains:
\nthe appropriate link to cancel the booking pursuant to Article 6
\nNext;
\nthe link to download and store a copy of these Terms.
\nThe Customer is advised to carefully review the summary and immediately report any errors or amendments.
\nBookings and purchases can only be made by customers who are of legal age.
\nFor minors, all purchases and\/or requests for the Service via the Website must be reviewed and authorised by a parent or legal guardian.
\nWhen making a booking, the Client warrants that they have the authority to accept the terms and conditions of the booking on behalf of their group.
\nThe contract is made with the Client who made the booking, who agrees to act on behalf of all members of the party for any booking and to be the sole point of contact.
\nThe Customer who made the booking will be responsible for organising all payments due to the Company under the contract and any material and\/or moral damages towards the Company.<\/p>\n

4. ONLINE PAYMENT AND PAYMENT ON SITE<\/b><\/p>\n

The contract is concluded when the booking form is received by the server used by the Company.
\nThe booking form shall be archived in the Company's database for the time necessary for its execution and, in any event, within the legal time limits. The language available to Customers for the conclusion of the contract is Italian.
\nIn the case of Online Payment, the Customer shall enter their payment details on the Website.
\nIn the case of On-Site Payment, the Customer must pay upon arrival at the chosen venue before starting the Game.
\nThe number of players at the time of the initial booking is indicative.
\nIn the case of Online Payment, if the number of players has decreased upon arrival at the chosen venue, the difference already paid will not be refunded; however, if the number of players has increased, the price will be adjusted to the current price list.<\/p>\n

5. GIFT VOUCHER<\/b><\/p>\n

The Customer has the option, by filling in the relevant form on the Website, to gift an Escape Room experience by purchasing a gift voucher to the value of one ticket, allowing them to participate in the Game.

Upon completion of the purchase, the Customer will receive an email communication containing the gift voucher.
\nOnce the gift voucher has been purchased, the type of room, day and time can be chosen by the recipient during the online booking phase described in Art. 3, by adding the voucher code.

\nreimburse the difference already paid; if, however, the number of players has increased, the price will be adjusted to the current price list.
\nThe voucher is valid for 6 months from the purchase date as indicated on the voucher.
\nThe gift voucher may only be purchased via Online Payment.<\/p>\n

6. BREAK<\/b><\/p>\n

Notwithstanding that the type of service offered on this Website falls, according to the Consumer Code, within one of the cases excluding the right of withdrawal (services concerning leisure activities where a specific date or period of performance is provided for pursuant to art. 59, paragraph 1, letter n) of Legislative Decree 206\/2005), the Company has decided to provide and regulate the right of withdrawal as follows.<\/p>\n

6.1 PAGAMENTO ONLINE<\/b><\/b><\/p>\n

If the Customer has chosen the Online Payment method, they have the right to cancel up to 12 hours before the scheduled start time of the booked gaming session via the link provided in the booking confirmation email; they will be refunded in the form of a voucher of equal value\u2014sent via email within 48 hours of cancellation\u2014containing a code to be used for a new booking made via the website within 30 days, noting that once used, the voucher cannot be reused or refunded.
\nIn the event of cancellation notified less than 12 hours prior to the scheduled start time of the game session, the Company will retain a penalty fee of \u20ac75 from the online payment; where applicable, it will issue a refund voucher for the remaining balance\u2014sent via email within 48 hours of the cancellation\u2014containing a code to be used for a new booking made via the website within 30 days, noting that once used, the voucher cannot be reused or refunded.<\/p>\n

6.2 PAGAMENTO IN SEDE<\/b><\/b><\/p>\n

If the Customer has chosen the On-site Payment method, they have the right to withdraw within 12 hours prior to the scheduled start time of the reserved gaming session.
\nIn the event of cancellation notified with less than 12 hours before the scheduled start time of the gaming session, the Company shall request, as a penalty within 48 hours of the date set for the game, payment of the amount of \u20ac70 through the Website via the link that will be communicated by the Company via SMS or email. Payment must be made within 3 days of the date set for the game.
\nIn default, the Company shall assign the recovery of the sum to its legal representative, with a consequent increase in costs to be borne by the Customer.<\/p>\n

3. OWNERSHIP OF GIFT VOUCHERS<\/b><\/b><\/p>\n

A customer holding a gift voucher who has booked a game session via the Site is entitled to cancel up to 12 hours before the scheduled start time of the session, using the link provided in the confirmation email.

\nIn the event of a cancellation communicated less than 12 hours before the start time of the gaming session, the Company will retain the full amount of the coupon as a penalty, and it will no longer be usable or refundable.
\nIn all the cases described above, the withdrawal must be communicated via the link contained in the booking confirmation email.
\nThe cancellation terms will also apply to bookings made less than 12 hours in advance of the booked time.<\/p>\n

6.4 GENERAL PROVISIONS<\/b><\/b><\/p>\n

The rules in this article apply to all bookings, regardless of the payment method, booking type, or time of booking\u2014including those made less than 12 hours before the scheduled game time.<\/p>\n

If the reservation is cancelled at least 12 hours in advance, no penalty will be applied.<\/p>\n

The rules set out in points 1, 2, and 3 apply at all times, without exception and regardless of the reason for cancellation\u2014including illness, strikes, adverse weather conditions, or other causes beyond the customer's control.<\/p>\n

To cancel a reservation, you must use exclusively the link provided in the confirmation email.<\/p>\n

By confirming the booking, the customer declares having read, understood, and accepted these General Terms and Conditions.<\/p>\n

7. INTELLECTUAL PROPERTY RIGHTS<\/b><\/p>\n

The Company owns all rights, in particular intellectual property rights relating to the Site, including its layout and design, and the trademarks and domain names used by and for the Site.
\nThe Customer acknowledges that the Company's trademarks and distinctive signs are the exclusive property of the latter.
\nConsequently, the Client will not be able to make any use or dispose of the asset in any form or manner.
\nunder such trademarks and\/or distinctive signs, whether combined with each other or with other trademarks and names, for any reason, without the prior written approval of the Company. .<\/p>\n

Also reserved and protected\u2014where applicable under Law no. 633 of April 22, 1941, and current legislation\u2014are the contents of the experiences offered by the Company, including puzzles, texts, set designs, settings, mechanisms, game sequences, audio\/video content, software, and other creative elements.
\nIt is prohibited to copy, reproduce, record, photograph, disseminate, or use such content\u2014even in part\u2014for the creation of other escape rooms, games, events, or commercial activities without the prior written authorization of the Company.
\nParticipation in the experience implies acceptance of this prohibition. The Company reserves the right to protect its rights through appropriate legal channels in the event of unauthorized use or reproduction.<\/p>\n

8. FORCE MAJEURE<\/b><\/b><\/p>\n

\u00a0<\/span>The Company shall not be liable under any circumstances for service interruptions attributable to force majeure or acts of God, even if caused by technical malfunctions and service interruptions, which result in the impossibility of carrying out the gaming session in the manner and at the times indicated in the booking. The Customer is, however, entitled to claim double the amount paid from the Company in cases where, outside the circumstances set out above,<\/p>\n

9. IMPEDIMENTS TO PARTICIPATION<\/b><\/p>\n

If it is not possible to participate in the experience, or if it cannot take place due to personal reasons, force majeure, or other unforeseeable circumstances, the conditions set out in Article 6 (\u2018Withdrawal\u2019), points 1, 2, 3, and 4, shall apply.\u00a0<\/span><\/p>\n

10. PRIVACY, IMAGE RELEASE, MINORS<\/b><\/p>\n

The Customer declares to have been duly informed regarding the processing of personal data and to have read the information notice pursuant to Article 13 of the GDPR, which can be consulted on the Website.<\/p>\n

11. Applicable Law and Jurisdiction<\/b><\/p>\n

The Conditions are subject to Italian law.
\nFor consumer Customers, any dispute relating to the application, execution and interpretation of these Conditions shall be submitted to the court of the place where the Customer resides or has elected domicile, if located within the Italian territory, without prejudice to the Customer's right to take legal action before a court other than the \u201cconsumer court\u201d pursuant to art. 66 bis of the Consumer Code, according to one of the criteria referred to in articles 18, 19 and 20 of the Code of Civil Procedure.
\nIf the customer habitually resides outside Italy, any mandatory provisions of their own country that are more favorable to the consumer remain applicable.<\/p>\n

12. ONLINE DISPUTE RESOLUTION FOR CONSUMER USERS<\/b><\/p>\n

The consumer customer residing in Europe should be aware that the European Commission has established an online platform that provides an alternative dispute resolution tool.
\nThis tool can be used by the consumer Customer to resolve out-of-court any disputes relating to and\/or arising from contracts for the sale of goods and supply of services entered into online.
\nConsequently, the Client may use this platform to resolve any disputes arising from the contract entered into online.
\nThe platform is available at the following address: ec.europa.eu\/consumers\/odr\/. Through the platform, the Customer will be able to consult the list of ADR bodies, find the link to each of their websites, and initiate an online dispute resolution procedure.<\/p>\n

13. RULES OF THE GAME<\/b><\/p>\n

By booking the game session, the customer agrees to inform all members of their group of the following rules:<\/p>\n
